Drain Waiver

Pool Drain Waiver & Liability Release

This Drain Waiver ("Waiver") is entered into between Splash Mob Pool Service LLC ("Company") and the customer ("Customer") requesting pool drain and refill services.

Acknowledgment of Risks

Customer acknowledges that draining a swimming pool involves inherent risks, including but not limited to:

• Potential damage to pool plaster, pebble, or tile surfaces from heat exposure or dehydration while the pool is empty
• Possible structural damage or pool "pop-up" due to hydrostatic pressure from groundwater
• Cracking, delamination, or discoloration of pool surfaces
• Damage to pool equipment if improperly operated during the drain and refill process
• Potential flooding from unexpected water sources during the drain process

Customer Responsibilities

Customer agrees to:

• Ensure proper city/municipal drain permits or waivers are obtained prior to service (Company may assist with this process)
• Provide clear access to the pool and equipment for the duration of the service
• Monitor the refill process if directed by Company
• Notify Company of any known structural issues, previous repairs, or concerns about the pool

Limitation of Liability

Company performs drain and refill services with professional care and industry-standard practices. However, Customer acknowledges that Company shall not be held liable for:

• Pre-existing surface conditions that become visible once the pool is drained
• Surface damage caused by environmental conditions (heat, sun exposure) during the drain period
• Hydrostatic damage to the pool structure
• Damage resulting from Customer's failure to disclose known issues

Service Conditions

Company reserves the right to:

• Refuse or postpone service during periods of extreme heat (typically May through September) when surface damage risk is elevated
• Recommend additional services (acid wash, surface repair) based on conditions discovered during the drain
• Adjust the timeline based on weather conditions or unforeseen circumstances
